Trump files countersuit against E. Jean Carroll over defamation claim of ‘rape’

Writer E. Jean Carroll made her appearance at the Manhattan Federal Court for the defamation case against former US President Donald Trump. Carroll accuses Trump of raping her in the 1990s. Trump, who was recently found liable in a civil jury trial for sexually abusing and defaming Carroll, has now filed a countersuit. He alleges that Carroll has defamed him by continuing to assert her rape allegations against him.

During a CNN interview, Carroll reiterated her claim that Trump raped her. However, Trump’s new counterclaim argues that while the jury found he sexually abused Carroll, it did not find by a preponderance of evidence that he raped her. Trump’s lawyer, Alina Habba, states that due to Carroll’s repeated false statements, Trump has suffered significant harm to his reputation. Habba emphasizes that the alleged rape was not committed according to the jury verdict.

Carroll’s attorney, Robbie Kaplan, disputes Trump’s claims, stating that the jury found Trump sexually abused Carroll and argues that Trump was not exonerated. Kaplan also highlights that the majority of the statements Trump considers defamatory are outside the statute of limitations, and the remaining statement is unlikely to withstand dismissal. Kaplan characterizes Trump’s countersuit as a deliberate attempt to delay accountability for his defamation.

This countersuit is the latest development in the legal battle over Carroll’s rape allegation against Trump. Initially going public in 2019, Carroll accused Trump of sexually assaulting her. Trump denied the claim, suggesting political motivations and a desire for book sales. Carroll subsequently filed a defamation lawsuit against Trump, with the trial set to begin in January 2023.

In addition to the defamation lawsuit, Carroll sued Trump for battery related to the alleged rape and for his defamatory comments. The trial for this second lawsuit ended with the jury ordering Trump to pay Carroll $5 million in damages. Trump is currently appealing this verdict.

Judge Lewis Kaplan, overseeing both cases, has allowed Carroll to amend her first lawsuit to include Trump’s post-verdict defamatory statements. Trump’s countersuit, filed in response to the amended lawsuit, denies Carroll’s allegations.

This ongoing legal battle coincides with the upcoming 2024 Republican presidential primary season, where Trump is a leading candidate.
