Block on Ban of First-in-Nation Abortion Pill

Wyoming’s ban on abortion pills, which was set to take effect on July 1, has been halted by a judge. The ban is now on hold while a lawsuit against it proceeds. This is the second ban to be temporarily blocked by the same judge, as the first ban on general abortion in Wyoming was also challenged. The judge has combined the two lawsuits into one.

Wyoming has become the first state to enact a specific ban on the use of pills for abortion. The law, signed by Republican Governor Mark Gordon, criminalizes the prescription, dispensing, distribution, sale, or use of any drug for the purpose of performing an abortion. However, individuals who use such pills to treat “natural miscarriages” will not face prosecution. Doctors or others found to have violated the law can be punished with up to six months’ imprisonment and a fine of up to $9,000.

Additionally, Governor Gordon has allowed a near-total ban on abortion to take effect without his signature. This law makes providing an abortion a felony. Abortion providers are considering legal challenges, expressing concern that these laws are eradicating access to vital healthcare services. Approximately half of abortions in the US are induced by medication, and while 28 states have restrictions on the use of abortion pills, Wyoming’s ban is the first explicit one. The law does not explicitly name the drugs, as some of them have other medical uses aside from abortion. Supporters of the ban believe it can be bypassed by simply changing the names of the drugs. Governor Gordon has called for a referendum on abortion to allow the issue to be resolved through a vote of the people.
