A federal judge denies a request to halt the execution of a Texas inmate who claims that the drugs to be used have been compromised by a recent fire. The Texas Attorney General’s Office states that tests conducted on the drugs after the fire show they are still safe and effective. Jedidiah Murphy, 48, is set to be executed on Tuesday for the fatal shooting of an 80-year-old woman during a carjacking in 2000.

In a lawsuit filed on Wednesday, Murphy’s lawyers state that the execution drugs were exposed to extreme heat, smoke, and water during a fire that occurred on August 25 at a prison unit in Huntsville. The Texas Department of Criminal Justice confirms the storage of the drugs at the Huntsville Unit. When pentobarbital, the drug used in executions, is exposed to high temperatures, it can degrade and lose potency. However, the test results of the samples prove that the drugs remain unaffected by the fire. Consequently, US District Judge Robert Pitman denies Murphy’s request to delay the execution.
