Why Calgary E. coli Outbreak Doesn’t Warrant Additional Food Regulations: Expert Opinions from Law Professors

Kate Maxwell is questioning why a kitchen that was suspected to be the source of the E. coli outbreak in a Calgary daycare was allowed to continue operating despite multiple inspections. Maxwell’s son was affected by the outbreak and she believes that more needs to be done to enforce regulations and guidelines. Law professors in Calgary are echoing Maxwell’s sentiments, stating that existing regulations need to be better enforced rather than implementing new ones. However, food safety expert Shaun Fluker suggests that better use of resources could be another solution. He argues that existing regulations and the powers under the Public Health Act are sufficient, but more rigorous inspections are needed. Premier Danielle Smith has acknowledged the issue and has ordered a review of food safety regulations for facilities serving daycares. Dr. Franco Rizzuti, Chief Medical Officer of Health for the Calgary region, assures that there is a strong public health team in place with enough inspectors. However, there has been a decrease in inspections in recent years due to public health restrictions during the COVID-19 pandemic. Both Fluker and Maxwell emphasize the need for proper enforcement and resources to ensure food safety. They argue that cutting regulations, or “red tape,” can have consequences and risks to the public. Keith Warriner, a food science professor, suggests that a balance needs to be struck between regulations, enforcement, and education. He believes that regulations should be tailored to childcare facilities and that compliance and understanding of regulations are crucial. Warriner also points out that simply increasing the number of food inspectors does not guarantee improved food safety. He cites previous E. coli outbreaks as examples of the limitations of inspections. Instead, he suggests empowering people to do the right thing and providing educational toolkits to ensure long-lasting adherence to regulations. The goal is to untangle the complexities of regulations and foster a culture of food safety.
