Trump Confronts Easter Egg Obstacle in Georgia Lawsuit

The indictments against Donald Trump have been released, and now the legal proceedings begin to determine important details such as the trial dates and jurisdictions. In Trump’s federal election interference case, the judge has set a trial date of March 4, 2024, just one day before Super Tuesday. This date is earlier than Trump would have preferred but later than what special counsel Jack Smith wanted. In the case against Trump in Georgia, former chief of staff Mark Meadows, one of the defendants, testified in an attempt to move the trial from state court to federal court, as reported by the Washington Post.

Meadows argues that the alleged crimes relate to his federal office duties, and therefore should be tried in federal court instead of state court. If successful, this argument could be detrimental to prosecutor Fani Willis’ case as the federal jury pool is larger and potentially more favorable to Trump. Axios reports that Trump and others are expected to present similar arguments. Additionally, there are unresolved questions in the Georgia case, including when the trial will take place (with one defendant already demanding a speedy trial, possibly in October) and whether all 19 defendants will be tried together or in separate trials.

Meanwhile, the New York Times reveals that the Georgia indictment against Trump contains what it calls an “Easter egg” that could complicate his argument for a federal court trial. The indictment alleges that Trump’s election interference continued well into September 2021, long after Joe Biden assumed the presidency. This timing undermines any claim that Trump was acting in an official capacity to ensure a fair election. Anthony Michael Kreis, an assistant law professor at Georgia State University, provided this analysis to the newspaper. (Read more Georgia indictment stories.)
