Texas Attorney General appeals judge’s decision to relax abortion ban for women facing pregnancy complications

In a move to challenge a district judge’s temporary injunction that relaxed Texas’ stringent abortion ban for women with dangerous pregnancy complications, the Texas attorney general’s office submitted an appeal on Saturday.

The appeal, filed directly to the Texas Supreme Court, aims to stay the ruling while awaiting a decision from the higher court. It emphasizes that the state’s pro-life laws remain fully in effect, despite the district judge’s ruling.

The attorney general’s office argues that limited exemptions are already included in the law, making the injunction unnecessary and excessive.

The appeal states, “Protecting the health of mothers and babies is of paramount importance to the people of Texas, a moral principle enshrined in the law which states that an abortion may be performed under limited circumstances, such as in the event of ‘a life-threatening physical condition aggravated by, caused by, or arising from a pregnancy’ that places the pregnant woman ‘at risk of death or poses a serious risk of substantial impairment of a major bodily function unless the abortion is performed or induced’.”

This appeal follows a ruling by Travis County District Judge Jessica Mangrum on Friday, which overturned the ban due to concerns about the law’s ambiguity regarding medical exceptions for abortions and doctors’ ability to exercise their professional judgment during pregnancy.

Mangrum argued in her injunction that doctors may be compelled to deny or delay necessary care for patients “for whom an abortion would prevent or alleviate a risk of death or risk to their health” due to fear of liability.

During the temporary pause, doctors can continue to provide emergency abortions when certain physical medical conditions are present without facing the ban.

In response to the ruling, the attorney general’s office affirmed its commitment to enforce the laws enacted by the Texas Legislature and protect the well-being of both mothers and babies.
