Supreme Court Abortion Decision, One Year Later: A Polarizing Mix of Scorn and Praise

Activists and politicians are commemorating the one-year anniversary of the landmark U.S. Supreme Court ruling that overturned the nationwide right to abortion. This milestone is being observed through a mixture of criticism and celebration. Both sides are organizing rallies in Washington and various locations across the country to voice their perspectives on this issue.

President Joe Biden released a statement in which he pledged to protect access to abortion and expressed his dismay over the Court’s decision in Dobbs v. Jackson Women’s Health Organization. On June 24, 2022, the conservative majority of the Court overturned the Roe v. Wade decision, which had been in place for almost fifty years. Biden highlighted the dangers posed by extreme and restrictive abortion bans implemented by states. He emphasized that these bans endanger the health and lives of women, necessitate arduous journeys for care, and potentially criminalize doctors fulfilling their duty to provide necessary healthcare services to their patients.

Ronna McDaniel, the Chairwoman of the Republican National Committee, applauded the ruling. She attributed the outcome to former President Donald Trump, who appointed three conservative justices to the Supreme Court during his tenure. McDaniel praised the decision as a life-saving measure that steers America away from the previous approach of allowing abortion on-demand, which she equated to practices in China and North Korea.

The Court’s decision turned abortion into a significant campaign issue and deepened the policy divisions between states. The majority of Republican-controlled states have implemented bans, with 14 states currently enforcing laws that prohibit most abortions throughout all stages of pregnancy, with limited exceptions for cases involving the life and health of the women, as well as pregnancies resulting from rape or incest. Conversely, most Democrat-led states have taken steps to safeguard abortion access, primarily by shielding healthcare providers from prosecution if they violate abortion bans established in other states.

Although widespread consensus among voters is lacking, public opinion polls consistently reveal that the majority opposes highly restrictive bans while also rejecting unrestricted abortion access throughout all stages of pregnancy.

President Biden has been advocating for a national law that reinstates abortion access, while Republicans push for a national ban. Former Vice President Mike Pence, a potential candidate for the 2024 GOP presidential nomination, has called on his party’s presidential contenders to support a ban on abortions after 15 weeks of pregnancy. However, with Democrats currently holding the presidency and control of the U.S. Senate, while Republicans possess the House, the chances of any federal legislation changes occurring in the near future are slim.

Consequently, the abortion debate has mainly unfolded within state legislatures and the judicial system. The resulting policies have significant practical implications. In states with the most stringent bans, the number of abortions has drastically declined, almost reaching zero. Conversely, states with maintained access to abortion services, particularly those neighboring states with bans, have witnessed an increase in the number of women traveling longer distances for care. This leads to an increased reliance on networks that distribute abortion pills.

Advocates argue that despite abortions continuing to occur, there remains an issue of equity. They emphasize that Black women and lower-income women, in particular, are the ones who disproportionately experience barriers to access.
