SBF Lawyers Criticize Insufficient Trial Preparation Time of 2 Days Weekly

Lawyers representing Sam Bankman-Fried have criticized the government’s plan for allowing their client to prepare for his fraud trial, stating that it is “entirely inadequate.” In a letter to US District Judge Lewis Kaplan, the lawyers argued that the limited amount of time and lack of resources provided to Bankman-Fried violated his constitutional rights to effective counsel and hindered his ability to review the substantial amount of evidence. They also pointed out that the arrangement prevented their client from sharing materials with them electronically. The lawyers requested that Bankman-Fried be allowed to meet with them five days a week at the Manhattan federal courthouse in order to adequately prepare for the trial, as he is currently being held at the Metropolitan Detention Center in Brooklyn.

A spokesperson for US Attorney Damian Williams declined to comment on the matter. However, prosecutors had previously informed Judge Kaplan that the federal marshals had made exceptional accommodations at the jail to accommodate the volume of materials and trial schedule. Security concerns resulted in redacted details concerning these accommodations in both letters.

Bankman-Fried is facing allegations of embezzling billions of dollars from FTX customers to support a separate hedge fund, engage in risky trades, purchase properties, and make political contributions. The 31-year-old former billionaire has pleaded not guilty to the charges and will be arraigned on August 22. Bankman-Fried’s bail was revoked by Judge Kaplan on August 11, after he found probable cause that Bankman-Fried had attempted to tamper with witnesses who were expected to testify against him. Prior to his arrest, Bankman-Fried had been under house arrest at his parents’ residence in Palo Alto, California. The Metropolitan Detention Center in Brooklyn, where Bankman-Fried is currently being held, has faced criticism for its inhumane conditions.

It is worth noting that Bankman-Fried’s lawyers previously represented Ghislaine Maxwell, the former girlfriend of Jeffrey Epstein, who also complained about the inadequate preparation conditions at the Brooklyn jail prior to her own trial for sex trafficking.
