Ramaswamy Seeks Conservative Appeal, Turns to Supreme Court

Vivek Ramsawamy, an innovative entrepreneur vying for the Republican presidential nomination, is taking a strategic step to showcase his conservative credentials to early-state voters who may have reservations about a candidate lacking a political background. On Monday, Ramsawamy will unveil a comprehensive list of potential choices for the U.S. Supreme Court. This move draws parallels to Donald J. Trump’s actions during the 2016 presidential campaign, when he faced scrutiny from Republican voters due to his past Democratic ties and moderate stance on certain issues.

The list compiled by Ramsawamy, as previously reported by Axios, features esteemed jurists who have presided over significant aspects of the Republican culture wars, encompassing religious matters, free speech, vaccine mandates, and transgender rights. In an official statement, Ramsawamy seeks to contrast his approach with that of President Biden, who pledged to nominate the first Black woman to the Supreme Court, subsequently fulfilled by the nomination of Ketanji Brown Jackson. Ramsawamy dismisses this move as a mere token gesture towards diversity.

Ramsawamy emphasizes that his selection of judges shares a steadfast commitment to the principles of originalism and a constitutionalist judicial philosophy. In his view, the courts represent the last line of defense against an administrative state that wields arbitrary power, legislates through judicial decisions, and stifles freedom and truth.

Rigorous scrutiny has been applied to the writings and decisions of the nine judges on Ramsawamy’s list. This process, led by Ramsawamy, his staff, and third-party organizations, focuses on evaluating their adherence to originalism and unwavering commitment to a constitutionalist judicial philosophy.

National surveys and early-state polls consistently place Ramsawamy behind not only former President Trump, but also Governor Ron DeSantis of Florida. However, Ramsawamy has dedicated significant time and effort to Iowa, where his list of potential Supreme Court justices holds significant weight.

The list includes prominent figures such as Senators Mike Lee of Utah and Ted Cruz of Texas. Lee was initially included in Trump’s 2016 list, while Cruz has been mentioned in other lists of conservative jurists. However, Cruz’s objection to certifying the results of the 2020 Electoral College, along with other potential objections, may draw criticism from Democrats.

Judge James Ho, serving on the Court of Appeals for the Fifth Circuit, which encompasses Louisiana, Mississippi, and Texas, is another notable inclusion. As a member of the conservative Federalist Society and a former clerk for Justice Clarence Thomas, Judge Ho vehemently opposes abortion rights.

Judge Lawrence Van Dyke, nominated by Trump in 2019 for the Court of Appeals for the Ninth Circuit, also appears on Ramsawamy’s list. However, concerns were raised by the American Bar Association regarding Van Dyke’s fairness toward the LGBTQ+ community.

Other esteemed individuals in Ramsawamy’s list include Judge Lisa Branch from the 11th Circuit Court of Appeals, Federalist Society member Paul D. Clement, Judge Thomas M. Hardiman from the Third Circuit Court of Appeals (previously shortlisted by Trump to replace Justice Antonin Scalia), Judge Justin R. Walker from the District of Columbia Circuit Court of Appeals, and Judge John K. Bush from the Sixth Circuit Court of Appeals.
