Possible Disqualification of Trump from Election Based on 14th Amendment, Suggests Adam Schiff

Rep. Adam Schiff (D-Calif.) raises serious questions about the eligibility of Donald Trump for the presidency.

In an interview on Sunday, the California congressman stated that there is strong evidence suggesting that Trump violates the third section of the 14th Amendment, which prohibits individuals who have “engaged in insurrection or rebellion” from holding elected office.

Schiff further elaborated on why there is a valid argument to exclude Trump from the ballot while appearing on MSNBC, following reports of potential challenges to Trump’s 2024 presidential candidacy by election officials across the country.

“If you engage in acts of insurrection or rebellion against the government, or you provide support to those who do, you are disqualified from running,” Schiff explained to host Jen Psaki.

“It doesn’t require a conviction of insurrection. It only requires engagement in these acts,” Schiff emphasized, noting how this definition perfectly applies to Donald Trump.

Trump has faced accusations of inciting the January 6, 2021, riots with his claims of election fraud. He currently faces multiple criminal charges for his actions during the attacks on the U.S. Capitol.

Schiff acknowledged that any case against the former president would face significant legal scrutiny. He mentioned that 14th Amendment-based challenges to Trump’s candidacy would likely reach the Supreme Court, which currently has a 6-3 conservative majority.

“That’s the big question mark in all of this,” the congressman wondered. “What will the Supreme Court do?”

“There are respected constitutional scholars, including prominent progressive scholars, who believe he should be disqualified,” Schiff continued.

“But ultimately, will the court take that step? Only time will tell, but the issue is undoubtedly legitimate. According to the clear terms of the 14th Amendment, he should be disqualified from holding office.”

Senator Tim Kaine (D-Va.) also made a similar case during an appearance on ABC’s “This Week,” stating that there is a “powerful argument” for invoking the 14th Amendment based on the Capitol attack’s aim to disrupt the peaceful transfer of power outlined in the Constitution.
