Opinion: Trump’s legal challenges have all been unsuccessful

Commenting on this story, it’s clear that former President Donald Trump has consistently lost important legal battles. Whether it’s civil or criminal cases, he has been unsuccessful in defending himself. This pattern should raise concerns about his ability to navigate future legal challenges, despite the excuses his team presents to the right-wing media.

For example, in the E. Jean Carroll case, Trump initially tried to argue that his defamatory statements during his presidency were protected by his official duties, but the court rejected this claim. After leaving office, he continued to make defamatory statements, leading the judge to allow Carroll to amend her complaint. Furthermore, in the second case brought by Carroll for sexual assault, Trump failed in his attempts to stall and dismiss the case. The jury found him guilty and awarded Carroll $5 million, with the judge calling Trump’s claims “frivolous.”

Moving on to other cases, Trump’s efforts to evade the New York criminal indictment for falsification of business documents have been unsuccessful. He has tried various tactics, such as demanding the recusal of the judge and moving the case to federal court, but none have worked. He will likely face trial within a year. Similarly, he has also failed to dismiss the state civil case brought by the New York Attorney General, which alleges that he inflated property values.

In the Georgia criminal investigation into the phony elector scheme, Trump has been unable to prevent former and current aides, political allies, and lawyers from testifying. He has claimed attorney-client privilege and executive privilege, but the courts have rejected these claims. His recent motion to dismiss the entire matter was unanimously denied by Georgia’s state Supreme Court. The court concluded that the petitioner had not shown that he would be entitled to the relief he sought. Trump’s baseless attacks against the Fulton County district attorney, including calling her “racist,” have no impact on the court’s decisions.

Trump’s attempt to return classified documents seized by a lawfully executed warrant and halt the investigation in the Mar-a-Lago documents matter was initially successful with a ruling in his favor. However, this ruling was swiftly overturned by the U.S. Court of Appeals for the 11th Circuit, and the case was dismissed.

In the underlying special counsel criminal investigation, Trump’s claims about declassifying documents and accusations of a conspiracy against him were dismissed. He lost attorney-client privilege because of the crime-fraud exception, and his lawyer became a witness for the government. Trump was later indicted on 37 counts. His attempt to postpone the case was unsuccessful, and the trial is set to begin next May.

Lastly, Trump lost more than 60 cases in his attempt to overturn the 2020 election. No significant fraud evidence was presented, and attorneys involved in these cases are facing potential disbarment. Over 1,000 rioters and plotters from the January 6 attack have been charged, with over 480 convicted. None have been able to prove a government plot or the involvement of left-wing groups.

Throughout all these legal battles, Trump has been unsuccessful in preventing top aides and advisers from testifying. His claims of attorney-client privilege and immunity have been rejected. He has received a target letter referencing charges such as obstruction of an official proceeding and conspiracy to defraud the United States. Soon, he will face juries who will decide his fate, and none of his excuses or tactics should protect him.
