NLRB Schedules February Hearing for Capital Roots and SEIU labor union

TROY – The National Labor Relations Board has scheduled a hearing on February 26th to address a complaint filed by the Service Employees International Union Local 200 United against the nonprofit nutrition group Capital Roots regarding their efforts to organize employees. This hearing marks the next phase in a yearlong battle between the union and Capital Roots over unionization.

In 2022, Capital Roots voluntarily recognized SEIU after the union took steps to organize around 20 non-management employees. However, relations between the two parties have since deteriorated. Union members have voiced concerns about employee terminations and unfair disciplinary action related to their union activity. Earlier this year, Capital Roots announced that their membership had rejected union representation, and no contract had been established.

Meanwhile, SEIU filed a complaint with the NLRB, which found merit in the allegations and proposed a settlement that was ultimately rejected by Capital Roots’ board of directors.

“This complaint should serve as a wake-up call to the board of directors who continue to support the current leadership style of Capital Roots,” said Sean Collins, the SEIU organizer, in a prepared statement. “The unlawful acts outlined in the complaint contradict the mission and values of Capital Roots. It is time for Capital Roots to take responsibility for these actions instead of wasting resources on a prolonged legal process.”

In response, Capital Roots CEO Amy Klein stated, “We eagerly await the opportunity to defend our organization before an impartial administrative law judge and resolve this matter, specifically addressing the false accusations of illegal terminations.”

It is important to note that a Capital Roots employee also filed a charge against SEIU, alleging refusing to bargain or negotiating in bad faith. The NLRB has yet to issue a ruling on this matter. If an agreement is reached between the union and Capital Roots before the February hearing, it may be postponed, according to the NLRB.
