Jeremy Morton-Maxson underwent surgery to remove a tumor on his bladder at the University of Washington Medical Center-Northwest on Aug. 17, 2022. He felt an urgent need to find out if the tumor was cancerous due to his family history. However, after waiting for two weeks for the results, Morton-Maxson started calling his urologist every day for answers. The news he received was distressing – his tumor sample had been lost, causing him a lot of anxiety.
Morton-Maxson, 38, is now taking legal action against UW Medicine and Washington state, alleging medical negligence and a violation of the center’s standard of care. The tumor has still not been found, but the university and state claim that it didn’t cause any harm to the patient. However, Morton-Maxson argues that the misplaced tumor has disrupted his treatment plan, leaving him unsure of how to proceed.
With the uncertainty of whether the tumor was cancerous, Morton-Maxson had two unappealing options: undergo grueling preventive chemotherapy or endure a painful bladder checkup every two months. He opted for the latter and hasn’t experienced any urinary issues since the procedure. However, he may need to continue these uncomfortable checkups indefinitely. The distressing situation has also taken an emotional toll on him, especially since he was originally informed that the tumor was likely cancerous.
Now, whenever Morton-Maxson experiences discomfort, he wonders if it’s a sign of cancer’s return. He believes that much of this could have been avoided with a simple apology for the mistake. “I understand that we all make mistakes,” he says. “But in those instances, you need to hold up your hand and say, ‘I messed up, and I am sorry.'”
