Lawsuits Filed by Authors Accusing OpenAI of Training ChatGPT with Their Books

Last week, OpenAI faced a lawsuit filed by two authors who claim that the company’s artificial intelligence chatbot, ChatGPT, was trained on their copyrighted books without their consent.

The authors, Paul Tremblay and Mona Awad, allege that ChatGPT produces “highly accurate summaries” of their works, suggesting that the chatbot was trained on their books, which would infringe copyright law.

OpenAI and the lawyers representing Tremblay and Awad have not responded to requests for comment.

ChatGPT is an advanced and creative chatbot developed by San Francisco-based OpenAI, led by Sam Altman and backed by Microsoft. It generates text based on written prompts, surpassing previous chatbot models developed in Silicon Valley.

The technology is trained on a large amount of text data, although OpenAI does not disclose the specifics. The company mentions web crawling, including the usage of archived books and Wikipedia, as part of the training process.

The lawsuit, filed in a San Francisco federal court, alleges that a significant portion of OpenAI’s training data is derived from copyrighted materials, including books authored by Tremblay and Awad. However, proving how and where ChatGPT obtained this information, as well as demonstrating financial damages suffered by the authors, may pose a challenge.

The complaint provides exhibits of the summaries generated by ChatGPT, acknowledging occasional inaccuracies. However, Tremblay and Awad maintain that the majority of the summaries are precise, indicating that “ChatGPT retains knowledge of particular works in the training dataset.”

“At no point did ChatGPT reproduce any of the copyright management information Plaintiffs included with their published works,” states the complaint.
