Lawsuit Filed by AFP against Musk’s X Alleging Copyright Infringement

On July 24, 2023, an illustration photo was taken in Los Angeles, showing the Twitter bird logo upside down on Elon Musk’s screen. In the background, Elon Musk is advertising an “X” as a replacement logo for Twitter. This event has prompted AFP news agency to file a copyright case against Twitter, now known as X, in France. This is part of a global effort to compel tech companies to compensate news organizations for their content. Media groups argue that their stories and images provide value to platforms like X, Facebook, and Google, and as a result, they should receive a portion of the profits.

Media groups received support from a 2019 EU law that permits payments for sharing content, known as “neighboring rights.” Eventually, Google and Facebook agreed to pay certain French media outlets. However, AFP has accused X, which is owned by billionaire Elon Musk, of refusing to engage in discussions about neighboring rights. In response, AFP has filed a case with a judge in Paris, demanding that X provide data necessary for the news agency to determine a fair level of compensation. AFP remains steadfast in advocating for neighboring rights for the press and will continue to pursue legal action with relevant platforms to ensure the equitable distribution of the value generated by the sharing of news content. X has not yet provided a comment regarding the case.

While media groups in France have achieved some victories, big tech firms have strongly resisted these efforts in other regions. Meta, previously known as Facebook, recently blocked users in Canada from accessing posts from news organizations due to a law requiring compensation for content. Google has also threatened to take similar action. Both Meta and Google have opposed similar proposals in Australia. These tech firms dominate online advertising and are accused of depriving traditional news organizations of financial resources while utilizing their content for free. X, being a smaller platform, has not faced the same level of scrutiny.

It is important to note that Meta, Microsoft, and numerous other entities hold trademarks for the new Twitter name, X. Elon Musk has unveiled a new “X” logo as a replacement for Twitter’s blue bird logo.
