Lawsuit Against Kraft Heinz Over Mac & Cheese Prep Time Ends in Favor of the Company

A federal judge in Miami has dismissed a lawsuit filed against Kraft Heinz, in which the company was accused of deceiving consumers by claiming that their microwavable Velveeta macaroni and cheese can be prepared in just 3-1/2 minutes.

US District Judge Beth Bloom ruled that the consumer who filed the $5 million class-action lawsuit, Amanda Ramirez, did not have the legal standing to pursue the case or demand changes to Kraft Heinz’s packaging.

Ramirez’s argument was that the packaging did not include the time needed to remove the lid, add water, and stir in the cheese sauce pouch, all of which are necessary steps. However, Judge Bloom pointed out that Ramirez never claimed she couldn’t cook or hadn’t tried the product and found that the product was not rendered useless in any way.

The judge also determined that there was no threat of future harm. Ramirez, who is from Hialeah, Florida, now understands that the 3-1/2 minutes mentioned on the packaging refers solely to the microwave cooking time, as clearly stated in the instructions.
