Judge rules in favor of resuming Georgia ban on hormone therapy for transgender minors

A federal judge has ruled that the ban on hormone therapy for minors in Georgia can resume, following a similar decision in Alabama last month, upheld by a federal appeals court.

The court injunction that halted Georgia’s ban last month came just one day before the 11th Circuit of Appeals ruled in favor of Alabama’s similar ban.

Under the Georgia ban, young people currently on hormone therapy can continue their treatment, but new patients are prohibited from receiving it. Additionally, the ban also restricts gender-affirming surgeries for minors.

In June, a group of parents with transgender children filed a lawsuit against the state, arguing that the ban violates their parental rights.

Judge Sarah Geraghty stated in her ruling last month that if the law were not halted, the plaintiffs would suffer “irreparable harm.” She emphasized that middle-school age plaintiffs would be deprived of recommended treatment for their individual diagnoses and mental health needs.

In light of the appeals court’s decision on the Alabama law, Judge Geraghty has chosen to temporarily pause the injunction. The state requested the complete removal of the injunction, but the judge declined that request.

Hormone therapy is a recognized form of gender-affirming care supported by major medical organizations, including the American Academy of Pediatrics, the American Medical Association, and the Endocrine Society.

The ban initially came into effect on July 1.
