A judge has approved a request by the ACLU of Southern California for access to certain law enforcement records pertaining to use-of-force incidents and officer misconduct. Los Angeles Superior Court Judge Curtis A. Kin stated that the city of Inglewood has failed to provide any valid reasons for denying the petition.
The ACLU’s petition was made under the California Public Records Act and Senate Bill 1421, which allows the public access to previously unavailable records concerning uses of force and police misconduct. These records include allegations of excessive force, instances where officers failed to intervene against excessive force, and communications exhibiting prejudice or discrimination based on race, religion, or disability.
Assistant City Attorney Derald Brenneman, in a sworn declaration, confirmed that some records could not be immediately released due to ongoing criminal, civil, or administrative investigations. The city will withhold these records until the statute of limitations expires or the investigations are concluded.
However, the judge ruled that the Inglewood Police Department has not adequately demonstrated efforts to obtain the requested records. Additionally, if the department’s records indicate that a document cannot be found despite their best efforts, the ACLU must be notified. The judge also stated that the ACLU is entitled to information regarding the destruction dates of any disposed records they seek.
