Hunter Biden’s Gun Case: A Fair and Unbiased Legal Pursuit

Hunter Biden plans to plead not guilty to three federal felony gun charges during his initial court appearance, according to his attorney. The attorney denied any claims of Hunter seeking “special treatment” at his first court appearance.

Abbe Lowell, Hunter’s lawyer, requested a video conference instead of an in-person court appearance at U.S. District Court in Wilmington, Delaware.

In a letter to Judge Christopher Burke, Lowell explained that the indictment can easily be read during a video conference, and there is no reason why Hunter cannot enter a plea of not guilty in that format. The scheduling of the court appearance is yet to be determined.

Last week, Hunter Biden was indicted on three criminal counts related to his possession of a firearm as an unlawful drug user. He is accused of lying about his illegal drug use and being in possession of a firearm as an unlawful drug user.

Lowell stated in his letter that Hunter is not seeking any special treatment, and requesting a video conference would minimize the burden on government resources and avoid disrupting the courthouse and downtown areas in Wilmington. However, federal prosecutors are opposing his request.

In late July, Hunter pleaded not guilty to misdemeanor charges of failing to pay federal taxes on over $1.5 million in annual income in 2017 and 2018. He had initially planned to plead guilty to those charges, but the deal fell through in court. Additionally, a pretrial diversion agreement on a gun-related crime, which could have allowed Hunter to avoid criminal charges, was also withdrawn.

Despite this, Lowell argues that the deal took effect and prevents Hunter from being charged with the gun crimes. He also claims that the charges are unconstitutional based on a 2022 Supreme Court ruling.
