Hochul Enacts Legislative Measure Safeguarding Doctors’ Legal Liability When Dispensing Abortion Pills Across State Borders

Governor Kathy Hochul of New York (D) demonstrated her commitment to women’s reproductive rights by signing a bill on Friday that provides legal protection for doctors who offer abortion care to patients in other states.

This groundbreaking law focuses on the use of telehealth to facilitate abortion access and shields doctors from facing legal action in states outside of New York. It prohibits state or local government employees from collaborating with individuals or out-of-state agencies in any matters related to legally protected health activities in New York.

In a news release, Governor Hochul expressed concern over the alarming erosion of women’s rights across the United States due to increasing restrictions on abortion access. She stated, “In New York, we stand firm in our commitment to ensuring that abortion remains safe, accessible, and legal.”

This legislation was signed by the governor on the eve of the one-year anniversary of the Supreme Court’s decision to overturn Roe v. Wade, a landmark ruling that protected the constitutional right to abortion. Shockingly, since the decision, 14 states have implemented near-total bans on abortion, according to an article published by The New York Times.

By passing this bill, Governor Hochul aims to enhance access to medication abortion and reproductive care. It ensures that healthcare providers can remotely deliver telehealth services to out-of-state patients without fear of legal or professional consequences.

She added, “With the implementation of this bill, New York is resolutely standing against restrictive abortion laws and striving to help all individuals access the necessary care they require.”

According to the Guttmacher Institute, medication abortions accounted for over half of all abortions performed in 2020, emphasizing the importance of telehealth services.
