Governor Hochul of NY enacts legislation safeguarding abortion pill providers

New York Governor Kathy Hochul recently held a press conference at her office on 633 3rd Avenue. During the conference, she addressed various topics including the COVID-19 pandemic, abortion rights, monkeypox, and inviting businesses to relocate to New York based on equality, abortion rights, and a friendly business climate. Governor Hochul’s announcement included signing a bill that protects doctors who prescribe and send abortion pills to patients living in states where the procedure is illegal. This legislation allows New York abortion providers to serve more out-of-state patients without fear of litigation, potentially expanding medication abortion access nationwide.

Medication abortion, which involves taking mifepristone and misoprostol, accounts for approximately half of all abortion procedures in the United States. However, more than a dozen states have implemented near-total abortion bans since the Supreme Court overturned the Roe v. Wade ruling. These state bans penalize individuals who assist with abortions. The issue of reproductive rights is expected to be a key focus in the 2024 election. A recent NBC News poll revealed that over 60% of registered voters disapprove of the Supreme Court’s decision to overturn Roe v. Wade.

In response to these restrictive abortion laws, Governor Hochul stated, “We are witnessing a shameful regression of women’s rights in this country as abortion access is restricted in states across the nation. With this bill, New York is continuing to fight back against restrictive abortion laws and help more people access the care they need.” The bill specifically protects New York doctors who use telehealth systems to serve patients in other states. Similar legislation has been enacted in Massachusetts, Colorado, Vermont, and Washington.

The bill also prohibits state law enforcement from cooperating with out-of-state litigation against doctors who use telehealth services for medication abortion or other reproductive healthcare. This legislation builds upon previous efforts to protect New York abortion providers from litigation, with a particular focus on telehealth services.

During the press conference, Governor Hochul made it clear that New York will not support efforts to penalize healthcare providers. She emphasized her determination to stop those who continue to pursue radical anti-abortion measures, declaring, “This is New York.”

This bill addresses the ongoing legal battle over mifepristone, a drug used in medication abortion. Anti-abortion doctors sued the FDA last year to remove mifepristone from the US market entirely, and a federal judge ruled in their favor. However, the Supreme Court has intervened in the case to preserve access to mifepristone while the litigation continues.
