Government Takes Strong Action Against Companies Promoting Cannabis Edibles in Child-Attractive Packaging

The Federal Trade Commission (FTC) issued a statement on Wednesday expressing concern over the sale of edible cannabis products packaged in a manner that resembles popular snacks marketed to children, such as Doritos chips and Oreo cookies. The FTC, along with the U.S. Food and Drug Administration (FDA), has jointly demanded that companies using such marketing practices immediately change their packaging to clearly indicate the presence of tetrahydrocannabinol (THC), the psychoactive compound found in marijuana.

In their statement, Samuel Levine, the director of the FTC’s Bureau of Consumer Protection, emphasized the importance of responsible marketing to ensure the safety of children. He referred to the marketing of THC-infused products that could be mistaken for regular foods as both reckless and illegal.

The FTC and FDA have taken action against six companies selling Delta-8 THC products in packaging that imitates child-friendly food. They argue that this deceptive packaging poses a health risk and potentially violates federal laws against unfair or deceptive acts in commerce.

Janet Woodcock, the FDA’s Principal Deputy Commissioner, highlighted the vulnerability of children to the effects of THC and the dangers of consuming edibles containing it. The FDA is warning companies selling copycat food products containing Delta-8 THC that closely resemble popular snacks, as they may be appealing to children and can result in unintentional ingestion of high doses of THC.

The FTC and FDA have ordered the companies to change their packaging immediately. One example mentioned is Dr. Smoke, which sells THC-infused “Doritos” that closely mimic the original packaging of Doritos Nacho Cheese Flavored Tortilla Chips. A similar issue arises with “Stoneo” cookies, which resemble Nabisco Oreos. The FDA has issued warnings to these companies, citing concerns about product appeal to children and potential confusion among consumers due to the similar branding.

Dr. Smoke and North Carolina Hemp Exchange, the maker of “Stoneo Oreo Cookies Delta-8 THC,” have not provided comments on the matter at this time. The FTC is urging consumers to keep cannabis edibles separate from other food items, child-proof cabinets and drawers where edibles are stored, and ensure proper resealing of packaging after opening.
