Federal Judge Lifts Injunction, Enabling the Implementation of Kentucky’s Ban on Gender-Affirming Care


A federal judge in Kentucky has lifted the injunction that temporarily blocked the state’s ban on gender-affirming care for transgender youth. The ruling means that transgender minors in Kentucky will be prevented from accessing puberty blockers and hormone therapy.

Kentucky Republican Attorney General Daniel Cameron, who sought the removal of the injunction, praised the decision, while LGBTQ+ advocates expressed their disappointment and concern over the impact on transgender youth. Chris Hartman, executive director of the Fairness Campaign, criticized the court’s ruling, describing it as an “American tragedy” and warned about the immediate harm it would cause to transgender individuals and their families.

The judge’s reversal comes after the U.S. Sixth Circuit Court of Appeals overturned a temporary injunction on a similar law in Tennessee.

Seven transgender children and their parents have filed a lawsuit challenging the Kentucky law, arguing that it violates their constitutional rights and interferes with parental rights to seek necessary medical treatment for their children. The ACLU of Kentucky’s legal director, Corey Shapiro, expressed confidence that a favorable outcome will be achieved in another federal court.

The transgender legislation in Kentucky was passed this year by the state’s GOP-controlled Legislature, overriding the veto by Democratic Governor Andy Beshear. The ACLU lawsuit specifically targets the sections of the law that ban puberty blockers and hormone therapy for transgender minors, but does not challenge other sections related to school bathroom policies and gender identity education.

Currently, at least 20 states have enacted laws restricting or banning gender-affirming medical care for transgender minors, and many of these laws are facing legal challenges. Recent court decisions have struck down bans in Arkansas and temporarily blocked bans in Alabama and Indiana.
