Since the US Supreme Court overturned Roe v. Wade last year, GOP-controlled states have been enacting abortion bans, including restrictions on abortion pills. These bans are now being challenged in court, setting the stage for a prolonged legal battle over access to abortion pills. In West Virginia, Judge Chambers determined that the regulation of medical professionals is an area where states have a strong interest and history of authority. This ruling underscores the state’s power to restrict access to FDA-approved drugs.

GenBioPro, Inc., the manufacturer of the generic version of the abortion pill mifepristone, argued that the state cannot block access to an FDA-approved medication. However, Judge Chambers dismissed most of the manufacturer’s challenges, affirming that the regulation of health, medicine, and medical licensure is traditionally within the domain of states. The judge did, however, allow a challenge regarding telehealth to proceed, suggesting potential limitations on the state’s authority in this specific aspect.

It’s important to note that while Congress has granted the FDA the power to dictate prescription protocols, the agency has endorsed telemedicine as a valid method for prescribing mifepristone. A federal appeals court ruling issued on August 16 will effectively end mail-order access to the drug for the most common form of abortion in the US, pending review by the Supreme Court.
