Discover the Latest Reforms in SCOTUS Ethics: Big Changes Coming!

Public confidence in the Supreme Court reaches a record low, but Justice Brett Kavanaugh assures change is on the horizon. During a judicial conference on Thursday, Kavanaugh addressed the “perceived ethical issues” and stated that the court is actively working towards resolving them. Chief Justice John Robert had previously expressed a similar sentiment in May. According to the Washington Post, Kavanaugh is optimistic about “concrete steps” being taken soon to address these concerns. The court’s reputation has suffered due to contentious rulings such as the reversal of Roe v. Wade and ethical concerns surrounding undisclosed trips funded by conservative donors involving Justices Clarence Thomas and Samuel Alito, as reported by the AP.

Even liberal justices like Sonia Sotomayor have faced ethical inquiries. Kavanaugh acknowledged the turbulent political climate and emphasized the importance for the legal system, including judges, to remain composed amidst the storm. He described the justices as dedicated public servants who deeply care about the court and the judiciary as a whole. Kavanaugh expressed the desire for the American people to have respect for the institution, even though disagreements over court decisions are expected, as mentioned by the Post.

Some legislators have been advocating for a binding code of conduct for the court. The Senate Judiciary Committee has pushed forward legislation to implement such a code and tighten disclosure rules. However, the Hill reports that it is unlikely to overcome Republican opposition. Dan Epps, a law professor at Washington University in St. Louis, views the pushback from elected officials as a positive influence. He believes it serves as a reminder to the justices that they are not above the law and that they ultimately serve the people, as highlighted in the Economist. (Read more US Supreme Court stories.)
