Diller Affirms Intent for Legal Action Regarding AI Publishing

Barry Diller, the chairman and senior executive of internet and media conglomerate IAC, has confirmed plans to take legal action along with a group of “leading publishers” regarding the use of published works in training artificial intelligence (AI) systems. In an interview on CBS’ “Face the Nation,” Diller expressed skepticism towards the overhyped nature of generative AI, comparing it to other revolutions in their early stages.

AI systems rely on large language models that consume various forms of written content, including books, news stories, and social media posts, to improve and develop their capabilities. Diller, along with others in the publishing industry, disagrees with how AI systems utilize their content. He emphasized the need for a business model that protects the copyright of publishers, highlighting the potential long-term catastrophic consequences if such a model is not established. Diller believes that legislation or litigation is necessary to safeguard publishers’ copyrights.

While Diller did not disclose the specific publishers involved in the planned litigation, he mentioned the 15-year struggle to implement paywalls that protect publishers, suggesting that a similar uphill battle may be expected.

When asked about the threat of generative AI to Hollywood studio workers’ jobs, Diller noted that immediate impact may be limited within the next one to three years. However, he acknowledged the existence of unresolved issues in the long run.

Comedian Sarah Silverman and two other authors are currently suing Meta and OpenAI, alleging copyright infringement. They claim that the AI systems of these platforms were trained using unauthorized copies of their books. Additionally, The Associated Press recently announced that it would license its news story archive to ChatGPT-maker OpenAI to assist in the training of their AI system.
