However, the judge stated that federal courts do not have the authority to reinstate Warren. The lawsuit focused on Florida law, which hindered the judge’s ability to take action. Warren, a twice-elected Democratic state attorney, petitioned the federal court to challenge his removal, citing concerns about the governor’s disregard for free speech, election integrity, and the rule of law. At a press conference, Warren reassured the public that he will continue to fight for justice. He explained that his suspension stemmed from his personal political beliefs regarding abortion rights and transgender issues. Judge Hinkle’s ruling largely supports Warren’s arguments but concludes that the matter should be handled at the state level rather than by a federal judge. The judge acknowledged that DeSantis falsely claimed that Warren had blanket policies against prosecuting certain types of cases. However, he noted that the Eleventh Amendment prevents federal courts from providing relief based on a violation of state law. DeSantis’ office did not respond to requests for comment.
