In a significant development, Attorney General Merrick Garland has announced the appointment of David Weiss, the current U.S. attorney overseeing the investigation into Hunter Biden, as special counsel. This appointment grants Weiss expanded powers and autonomy to continue the probe. Weiss, who was initially appointed by former President Donald Trump in 2018, has been leading the investigation into allegations against President Joe Biden’s son since the following year. Garland emphasized that Weiss’ promotion reinforces the Department of Justice’s commitment to independence and accountability in sensitive matters.
Weiss formally requested the designation of special counsel after informing Garland that the investigation had reached a critical stage. Garland, recognizing the exceptional circumstances of the case, agreed that it was in the public interest to grant Weiss this role. As special counsel, Weiss will continue to serve as the U.S. attorney in Delaware but will not be subject to day-to-day supervision by any Justice Department official. He will retain full authority over the investigation, including the decision to file charges.
Once the investigation concludes, Weiss will provide Garland with a detailed report explaining any prosecutorial decisions. The attorney general has pledged to disclose as much of the report as possible, ensuring transparency in the process. This announcement allows the prosecutors, agents, and analysts involved in the case to continue their work promptly and make decisions based solely on the facts and the law.
House Republicans, however, remain skeptical of Weiss’ appointment, viewing it as an attempt to conceal alleged corruption within the Biden family. They argue that Weiss cannot be trusted, referring to his previous endorsement of a plea deal that was rejected by a federal judge. Representatives Jim Jordan and James Comer, among others, contend that the move is a deliberate effort to impede congressional oversight. These claims have been denied by both the White House and top officials at the Department of Justice, who assert that the investigation is entirely independent and free from political interference.
