According to a spokesperson’s statement to Insider, “Delta confirms that one of its crew was taken into custody [Friday] morning at EDI Airport. Delta is assisting the authorities with their ongoing inquiries.” The spokesperson did not disclose the specific role of the crew member, but Mateusz Maszczynski, a flight attendant and blogger for airline workers, reported that the pilot of the plane was arrested and detained.

According to Maszczynski, the crew member was charged under the Railways and Transport Safety Act of 2003, which includes regulations on alcohol consumption for crew members.

The spokesperson declined to provide a reason for the arrest but emphasized that “Delta’s alcohol policy is among the strictest in the industry, and we have zero tolerance for violations.”

Under the Railways and Transport Safety Act, the legal blood-alcohol limit for airline crew members is 20 milligrams of alcohol in 100 milliliters of blood. In comparison, the blood-alcohol limit for driving a car in Scotland is 50 milligrams of alcohol in 100 milliliters of blood.

According to Maszczynski, anyone found guilty of exceeding the prescribed limit can face a maximum penalty of a two-year jail sentence.
