Conservative States Continue to Support Abortion Rights through Ballot Measures

Organizers at the Columbus Fire Fighters Local 67 in Ohio celebrated the defeat of Issue 1 during an election night party on August 8, 2023. This marked the third time in a year that voters in a conservative state rejected attempts by Republicans to make constitutional changes targeting abortion.

Issue 1, which aimed to raise the threshold for constitutional changes in Ohio from a simple majority to 60% of ballots cast, was resoundingly rejected by Ohioans. While the vote did not directly address abortion, the failure of Issue 1 increases the likelihood that an amendment guaranteeing abortion rights in the state constitution will pass when voters return to the polls in November.

Preliminary results from the Ohio Secretary of State’s Office showed that nearly 40% of registered voters participated in Tuesday’s election, indicating that abortion remains a significant issue motivating voters leading up to the 2024 presidential election.

The trend extends beyond Ohio, as other Republican-dominated state legislatures have placed abortion-related questions directly before voters following the Supreme Court’s decision in June 2022 to eliminate federal constitutional protections for the procedure. Kansas and Kentucky have also witnessed unfavorable results for anti-abortion activists, with voters rejecting amendments that would have stripped state constitutional protections for abortion.

The impact of the abortion issue on elections is evident. In last year’s midterm elections, Democrats were able to mitigate losses in the House and maintain control of the Senate partially due to the support of voters concerned about abortion. It is anticipated that the issue will play a crucial role in attracting Democrats and independents in key swing states during the 2024 presidential election.

President Joe Biden condemned Issue 1, characterizing it as an attempt to weaken voters’ voices and curtail women’s healthcare decision-making freedom. The rejection of the Republican-backed measure in Ohio is also good news for Sherrod Brown, the senior Democratic senator facing a challenging reelection battle next year in a heavily Republican-trending state. Brown stated that Ohio voters rejected a “power grab” by special interests and the wealthy.

Notably, a recent poll conducted by USA Today and Suffolk University revealed that 58% of Ohioans support a constitutional amendment protecting abortion rights in their state.

Looking ahead to the 2024 presidential election, the fight over abortion access is expected to impact Democratic turnout in the swing state of Arizona. Activists in Arizona have submitted a proposed constitutional amendment to safeguard abortion access, and they need to collect over 380,000 signatures for it to be included in the 2024 general election ballot.

In Florida, abortion rights activists have already begun collecting signatures to hold a referendum in 2024 on a constitutional amendment that would prevent the state from restricting abortion access. Floridians Protecting Freedom, the political action committee behind the campaign, launched their efforts after the enactment of a six-week abortion ban by Florida Governor Ron DeSantis, a prominent Republican presidential candidate. The coalition has gathered almost 500,000 signatures so far, with a goal of exceeding 890,000 signatures to secure the constitutional amendment’s placement on the ballot.

Lauren Brenzel, the campaign director for Floridians Protecting Freedom, sees the defeat of Ohio’s Measure 1 as a positive sign for their efforts in Florida. She views it as part of a growing series of victories nationwide that bodes well for the success of their campaign.

Overall, the rejection of Issue 1 in Ohio and the ongoing battles in Arizona and Florida highlight the significant role the abortion issue plays in shaping elections and political landscapes across the United States.
