Agence France-Presse files lawsuit against Elon Musk’s X over news content

Agence France-Presse, the French news service, announced on Wednesday that it is initiating legal proceedings against Elon Musk’s X company, formerly known as Twitter. The agency alleges that X is refusing to negotiate payment terms for the use of their news content.

In 2019, France adopted comprehensive European Union copyright regulations that require social media companies to compensate publishers for specific types of content. After months of negotiation, Google agreed to pay French publishers for news content.

The agency stated in their official statement, “These rights were established to allow news agencies and publishers to be compensated by digital platforms that primarily benefit financially from the distribution of news content.”

Musk responded to the lawsuit in a tweet on Wednesday, calling it “bizarre.” He wrote on X, which he acquired in October, “They want us to pay *them* for traffic to their site where they make advertising revenue and we don’t!?”

Similar regulatory proposals that aim to make social media platforms compensate publishers for their content have faced opposition. Meta announced in June that it would block Canadians from sharing news on Facebook and Instagram in response to a new Canadian law that requires social media companies to pay domestic publishers for their content.

Meta also threatened to block California users from sharing news on its platforms in May, as state legislators considered legislation mandating that social media companies pay news outlets for their content.

In 2021, Australia passed a similar law requiring these companies to negotiate agreements with Australian news outlets for the content posted on their platforms. Meta and Google responded differently to this law, both striking deals with Australian news outlets for the use of their content.
