Victory for ‘Better Call Saul’ Creators: Overcoming Defamation and Trademark Lawsuit

In a victory for the creators of “Better Call Saul,” a popular crime drama series, a defamation and trademark infringement lawsuit filed by Liberty Tax Service has been dismissed. The lawsuit claimed that the depiction of a fictional tax firm called “Sweet Liberty Tax Services” in an episode of the show resembled the real company, leading to confusion among viewers. However, US District Judge Paul Gardephe ruled in favor of AMC Networks and Sony Pictures Television, stating that Liberty Tax failed to provide strong evidence supporting their allegations.

The controversial episode, titled “Carrot and Stick,” featured Sweet Liberty Tax Services operating in a trailer in the New Mexico desert. The fictional firm, run by former clients of corrupt lawyer Saul Goodman (played by Bob Odenkirk), was shown using patriotic imagery such as an inflatable Statue of Liberty and an American flag motif while engaging in tax refund fraud.

Judge Gardephe emphasized that the use of Liberty Tax’s trademarks in the episode served the purpose of advancing the plot, rather than for marketing or disparagement of the real company based in Virginia Beach, Virginia. He described the fictional firm’s use of patriotic imagery as a reflection of the Kettlemans’ hypocrisy and the sordid nature of their crimes, which were pertinent to the story.

Drawing a distinction, Judge Gardephe referred to a previous case involving hip-hop duo Outkast, where the use of civil rights activist Rosa Parks’ name for a song unrelated to her was deemed a marketing tool. In that case, Parks’ trademark claim was reinstated and later settled. The judge deemed the use of Liberty Tax’s trademarks in “Better Call Saul” as part of the show’s artistic expression, protected by the First Amendment of the US Constitution.

Although Liberty Tax is considering legal options, including an appeal or refiling the lawsuit in a state court, lawyers for AMC and Sony did not respond immediately to requests for comment. “Better Call Saul,” a prequel to the popular series “Breaking Bad,” concluded its six-season run in August 2022.
