Trump Requests Georgia’s Supreme Court to Dismiss Election Prosecutor

The legal team representing former President Donald Trump is urgently appealing to Georgia’s highest court to halt the ongoing prosecution by the district attorney investigating his actions following the 2020 election. Additionally, they are requesting the dismissal of a special grand jury report that forms a crucial part of the inquiry.

Fanni Willis, the Fulton County District Attorney, has been conducting an investigation since early 2021 into potential violations of the law committed by Trump and his supporters in their attempts to overturn his narrow election loss to Joe Biden in Georgia. Willis has indicated her intention to seek charges through a grand jury as early as next month.

In an effort to address the pressing timeline, Trump’s legal team, comprised of Drew Findling, Jennifer Little, and Marissa Goldberg, filed petitions in both the Georgia Supreme Court and Fulton County Superior Court. The petitions named Fanni Willis and Fulton County Superior Court Judge Robert McBurney, who presided over the special grand jury, as respondents. A spokesperson for Willis declined to comment, while McBurney did not respond to an email requesting comment.

The legal team, acknowledging the unusual nature of the filings, emphasized their necessity given the time constraints. Willis has indicated an intention to use the special grand jury report to pursue an indictment “within weeks, if not days.” This week, two new regular grand juries have been seated, with one likely to handle the case.

“Even in an extremely unique case of national importance, one would expect the standard procedural course to be followed within a reasonable timeframe,” state the filings. “However, nothing about these proceedings has been normal or reasonable. It is increasingly evident that the irregularities thus far can be attributed to Petitioner’s status as President Donald J. Trump.”

The petitions aim to prevent Willis and her office from further prosecuting the case. They also seek the dismissal of the special grand jury report and an injunction to prevent prosecutors from introducing any evidence obtained from the panel’s investigation to a regular grand jury.

The filings request a halt to “all proceedings related to and arising from the special purpose grand jury’s investigation until this matter can be resolved.”

Previously, in a filing from March, Trump’s lawyers made similar requests, including the petition that a different judge hear their claims rather than McBurney. Willis dismissed these arguments as baseless, resulting in McBurney retaining the case without ruling on the requests made by the Trump team.

Consequently, Trump’s legal team asserts that he is now caught “between the Supervising Judge’s extensive inaction and the imminent indictment by the District Attorney.” They claim that seeking intervention from the Supreme Court is the only option available to them.
