Trump New York Fraud Trial Set to Commence Amid Appeals Panel Decision

The New York civil fraud trial of former President Donald Trump and his company is set to begin on Monday, following an appeals panel lifting a temporary stay on the trial’s start.

In a statement, New York Attorney General Letitia James announced her intention to call Trump and his three adult children as witnesses during the trial of her lawsuit in Manhattan Supreme Court.

Trump’s request to block the trial’s start and dismiss certain claims in James’ lawsuit due to the statute of limitations was rejected by a five-judge appeals panel. The panel determined that the trial should proceed.

The lawsuit accuses Trump, the Trump Organization, and his sons Donald Trump Jr. and Eric Trump of misrepresenting the values of various real estate assets and other claims.

Earlier this week, Judge Arthur Engoron found the defendants guilty of fraudulently inflating those properties and ordered the dissolution of their businesses. The trial will now focus on the remaining claims in James’ suit, seeking approximately $250 million in damages and a ban on the defendants conducting business in New York state.

An appellate judge briefly halted the trial to allow the five-judge panel to consider Trump’s argument to dismiss certain claims. This argument was based on a previous ruling that removed Ivanka Trump as a defendant due to the statute of limitations.

The appeals court left it to Judge Engoron to determine the extent of the statute of limitations’ impact on the other defendants involved in the case.

Trump’s latest appeal objected to the trial proceeding without a prior determination on the statute of limitations from Judge Engoron.

The five-judge panel did not provide an explanation for rejecting Trump’s appeal.
