In a significant development, the Justice Department announced on Tuesday that former President Donald Trump is not entitled to immunity in the defamation lawsuit filed against him by E. Jean Carroll. The lawsuit, filed in 2019, revolves around Trump’s statements denying Carroll’s rape allegations and discrediting her by saying she is not his type. During Trump’s presidency, the Department of Justice under his administration claimed he was protected by presidential immunity, but this stance has now been reversed by the department under President Joe Biden, as reported by The Guardian. Another lawsuit filed by Carroll, focusing on comments made by Trump after leaving office, recently went to trial, and Trump was found liable for sexual abuse and defamation.

In a letter filed in court, the Department of Justice states that the statements made by Trump were not within the scope of his official duties and were related to a personal incident from decades ago. Consequently, they determined that Trump was not “sufficiently actuated by a purpose to serve the United States Government” and therefore should not be covered by presidential immunity. The trial for Carroll’s lawsuit could potentially begin in January, and Trump will have to rely on his own legal team instead of being represented by the government. A spokesperson for Trump criticized the DOJ reversal, accusing Biden of politically weaponizing the justice system and perpetuating a hoax.
