In terms of purchasing and possession limits, Berkowitz explained that individuals are allowed to purchase and possess up to 1.5 ounces of cannabis flower, 12 grams of concentrated cannabis, or up to 750 mg of THC, which is the same as the possession limit for personal use. Possessing more than 1.5 ounces but less than 2.5 ounces of cannabis could result in civil fines, while possession of more than 2.5 ounces may be considered an intent to distribute and could lead to criminal charges.
The new law also includes provisions for convictions of marijuana-related crimes that have now been made legal. These convictions will be automatically expunged, and those currently serving time for these offenses will be eligible for resentencing. Individuals who were convicted of possession with the intent to distribute can petition the courts for expungement three years after completing their sentences.
Furthermore, the state of Maryland will now allow companies to serve medical cannabis to customers. Nearly 100 dispensaries have been approved by state regulators to convert to dual licensees, meaning they can serve both patients and adult consumers, as permitted under the ballot measure passed last year.
