Two attorneys who submitted court briefs riddled with errors, with assistance from ChatGPT, have been fined $5,000 each by Judge P. Kevin Castel of Manhattan’s Federal District Court. Furthermore, they are required to inform each of the actual judges whose names were falsely used in the filings about the case’s outcome. Judge Castel emphasized that the decision to apologize to the judges lies with the attorneys themselves, as a forced apology lacks sincerity, according to the New York Times. During a previous hearing, Castel criticized Steven Schwartz and Peter LoDuca, accusing them of neglecting their duties and fostering skepticism towards the legal profession and the American judiciary, as reported by CNBC and the Times.


“The submission of fake opinions leads to many harms,” wrote Judge Castel. The deception wastes both time and money, as it requires efforts to uncover the falsehood. In addition, such actions may encourage future litigants to doubt and challenge judicial rulings. The judge highlighted that Schwartz and LoDuca could have avoided sanctions if they had not persisted in defending the falsified opinions after their existence was questioned by court orders. Although not mandated by the judge, the attorneys’ firm, Levidow, Levidow & Oberman, plans to implement mandatory training on artificial intelligence programs, according to the Times. In a separate ruling, Castel dismissed the lawsuit against Avianca airline, in which the fraudulent briefs were submitted, citing the expiration of the statute of limitations.
