Contrary to initial skepticism, a federal indictment of Donald Trump for mishandling classified information is now a reality. Many believed that Trump’s flagrant actions would go unchecked due to the perceived imperviousness of our justice system and the lack of courage from Attorney General Merrick Garland. Trump’s cunning tactics seemed to suggest that he could outsmart the law, almost as if he were a monarch.

Instead of asking “Can he do that?” during his presidency, the more important question was always “Who will hold him accountable if he does?”. Up until recently, the answer was nobody. This meant that the answer to the first question was a resounding yes. However, the Constitution itself, with its fundamental principle of government accountability to the people, has caught up with Trump.

The Founding Fathers, having revolted against absolute monarchy, sought to establish a government where power is ultimately derived from the consent of the governed. They denounced King George III and emphasized that the people are the legitimate source of power in the Constitution. The Supreme Court has also consistently emphasized that the government should be directly responsible to the people.

The concept of accountability goes hand in hand with government by the people. In the age of Trump, accountability became increasingly elusive due to the vague language of the Constitution and its complex structure. It failed to provide clear answers to the novel questions raised by Trump’s actions, such as whether he could obstruct investigations into his own wrongdoing. Without a prosecution, the judicial branch had no chance to intervene. Impeachment, a primary check on a president’s misconduct, also failed to hold him accountable.

Trump’s supporters may view the recent indictment as politically motivated harassment, but it is a demonstration of legal accountability under a fair system of laws. Unlike previous investigations, there is sufficient evidence to criminally charge Trump based on the laws enacted by Congress.

Now, Trump’s fate lies in the hands of the judicial branch, consisting of lifelong appointed judges and a jury of his peers. Trials, governed by authenticated evidence, established procedures, and constitutional rules, provide the impartial administration of justice. Trump will face the American people in a federal court in Florida, where they will finally have their day in court. This will ultimately strengthen the Constitution itself.
