Texas Supreme Court upholds law prohibiting gender-affirming care for most minors

The Texas Supreme Court has rejected a motion to halt a new law that will prohibit gender-affirming care for most minors. This law, which was passed by the Texas state legislature and is set to take effect on Friday, has been met with resistance from families and physicians who filed a lawsuit to block its implementation. Last week, a district court temporarily halted the law, deeming it a violation of transgender children’s rights. However, the Texas attorney general’s office appealed to the state Supreme Court, which is composed entirely of Republicans.

Known as SB14, the bill seeks to prevent transgender minors from accessing hormone therapies, puberty blockers, and transition surgeries. It also includes provisions for gradually discontinuing treatments for those already undergoing them. It’s worth noting that gender-affirming surgical procedures are rare for children, according to medical experts.

The plaintiffs in the lawsuit argue that “transgender adolescents in Texas will lose access to safe, effective, and medically necessary treatments, and their parents will lose the ability to make decisions regarding their children’s medical care.”

No explanation was provided by the state Supreme Court for its decision to uphold the law. Texas is among over 20 states that have introduced laws to ban gender-affirming care, but not all of them have taken effect yet. Texas, being the most populous state to enact such a ban, stands out among the rest.
