US Civil Rights Agency Sues Tesla Over Harassment of Black Employees

The US Equal Employment Opportunity Commission (EEOC) has filed a lawsuit against Tesla, accusing the electric carmaker of tolerating severe harassment of black employees at its flagship Fremont, California assembly plant. The EEOC claims that Tesla has allowed racist slurs and graffiti, including swastikas and nooses, to occur routinely at the plant since 2015.

The lawsuit alleges that Tesla has failed to properly investigate complaints of racist conduct and has retaliated against workers who report harassment by firing them or taking other punitive actions. Several other race discrimination lawsuits have been filed against Tesla, including a class action suit by Fremont plant workers and a lawsuit by a California civil rights agency. In response, the company has maintained that it does not condone discrimination and takes complaints seriously.

The EEOC’s lawsuit seeks compensatory and punitive damages for affected black workers, as well as an order requiring Tesla to revise its policies on discrimination and retaliation. The lawsuit comes amid similar claims by the California Civil Rights Department, which alleges racial discrimination in pay, promotions, and work assignments.

Tesla’s stock price rose 2.4% following the announcement of the lawsuit. The company has not provided an immediate comment on the matter.

Charlotte Burrows, the chair of the EEOC, stated that combating workplace harassment is a top priority for the agency. She expressed outrage at the racial bigotry revealed during their investigation, emphasizing the importance of respecting civil rights in the workplace.

Meanwhile, unrelated to the EEOC lawsuit, a former elevator operator at the Fremont plant named Owen Diaz is seeking a third trial in his racial harassment lawsuit against Tesla. In his previous trials, Diaz was awarded $3.2 million and $137 million, respectively, and he opted for a new trial to avoid a reduced award of $15 million.

Tesla is also facing a class action lawsuit in California state court over the mistreatment of black factory workers, with around 240 workers joining the legal action.
