Supreme Court Upholds Law on Convicting Individual Involved in ‘Adult Adoption’

The Supreme Court has upheld a section of federal law that allows for the prosecution of individuals who encourage illegal immigration. In a 7-2 vote, the court rejected the argument that the law is too broad and violates the Constitution. The case involved a California man named Helaman Hansen, who deceived non-citizens by offering adult adoptions that he falsely claimed would lead to US citizenship. Despite knowing that these adoptions would not result in citizenship, Hansen collected over $1.8 million from at least 471 people. He was ultimately convicted of encouragement charges and fraud charges, receiving a 10-year prison sentence for the former and a 20-year prison sentence for the latter. A federal appeals court previously overturned the encouragement convictions, deeming the law overbroad and in violation of the First Amendment’s free speech clause. The case is known as United States v. Helaman Hansen, 22-179.
