Strengthening the Endangered Species Act

The Biden administration took decisive action on Wednesday to enhance wildlife protection in the face of climate disruption and other threats. They reinstated the protections of the Endangered Species Act that were previously removed by President Donald J. Trump.

Both the United States Fish and Wildlife Service and the National Oceanic and Atmospheric Administration’s fisheries service proposed three separate regulations that would strengthen the criteria for removing a species from the endangered list and make it more challenging to weaken protections for threatened species, which are one step away from being endangered.

In addition, these rules eliminate a policy implemented during the Trump era that would have allowed regulators to consider economic factors, such as estimating losses in revenue for oil and gas operations, when determining whether a species should be protected. The proposed rule clearly states that listing a species as threatened or endangered should be based solely on scientific evidence and without any consideration of possible economic impacts.

Martha Williams, the director of the Fish and Wildlife Service, emphasized the importance of the Endangered Species Act as the nation’s leading conservation law that safeguards species from extinction and supports their recovery. She expressed that the proposed changes to the law further reinforce the commitment to conserve America’s wildlife.

It is anticipated that the proposed rule will face opposition from Republicans, as well as from farmers, ranchers, the logging industry, and the oil and gas industry. The Trump administration argued in 2019 that the Endangered Species Act impeded economic growth by narrowing its scope.
