State Senator Dave Min, a Democratic representative from Irvine who is currently campaigning for Congress, has entered a plea of no contest to a misdemeanor charge of driving under the influence in Northern California. As a result, Min has been placed on three years of probation. This news was announced on Wednesday.
In Sacramento County Superior Court on Tuesday, Min pleaded no contest to driving under the influence of alcohol with a blood alcohol concentration exceeding the legal limit of 0.08. The court sentenced him to two days in jail, a three-month first offender program, and three years of informal probation. Shelly Orio, a public information officer for the Sacramento County District Attorney’s Office, provided these details.
When contacted by City News Service for a response, Min’s office referred to a statement that he had issued at the time of his arrest.
In May, Min’s office released a statement in which he expressed remorse for his actions. “Last night, I was cited for a misdemeanor for driving under the influence,” he said. “My decision to drive last night was irresponsible. I fully accept responsibility, and there is no excuse for my behavior. I extend my deepest apologies to my family, constituents, and supporters. I know that I must improve. However, I will not allow this personal failure to detract from our important work in California and Washington.”
The California Highway Patrol officer who stopped Min in Sacramento on May 2 initially pulled him over for driving without headlights, according to the CHP.
Min was driving a Toyota Camry south on Ninth Street when the officer observed that he did not have his headlights on at 10:23 p.m. The CHP reports that the officer followed the vehicle to Ninth Street at Broadway, where the Camry stopped at a red light but proceeded into the intersection while the light was still red.
The officers involved in the incident noticed “signs and symptoms of alcohol intoxication” after pulling Min over.
Following his arrest on suspicion of misdemeanor DUI, Min was booked into the Sacramento County Jail without incident, according to the CHP.
Scott Baugh, a Republican who is also running for the same congressional seat currently held by Democrat Katie Porter, declined to comment on the matter.
