Son of Schwarzenegger Successfully Granted Motion to Depose Plaintiff in Traffic Collision Lawsuit

A victory has been achieved by the son of actor and former Governor Arnold Schwarzenegger in court, as a judge has ordered the deposition of one of the three plaintiffs involved in a consolidated lawsuit. These plaintiffs claim to have been injured in a car crash with Schwarzenegger’s son in Brentwood in 2020.

Judge Anne Hwang of the Los Angeles Superior Court is overseeing the combined cases brought by Maryam Pirian, Manouchehr Pirian, and Gad Kakanyisa. Court documents filed by Christopher Schwarzenegger’s attorneys state that Kakanyisa was notified to appear for a deposition on June 1 and initially had no objection to the date. However, within 48 hours, he claimed that he was unavailable.

On Friday, Judge Hwang ordered Kakanyisa to appear for a deposition within 30 days and imposed a fine of $1,545 to cover attorneys’ fees and costs.

“The court has determined that the plaintiff failed to attend a deposition that was properly noticed and did not serve a valid objection,” stated Judge Hwang.

According to court documents filed by Schwarzenegger’s attorneys, Kakanyisa did not respond to inquiries regarding rescheduling the deposition or his failure to appear on June 1.

“This failure to communicate with defense counsel is unreasonable, and the plaintiff’s actions have resulted in unnecessary delays and expenses,” according to court papers filed by Schwarzenegger’s lawyers. They requested a fine of approximately $2,330, but the judge deemed that amount excessive.

The Pirians, both 78 years old, state that they were driving south on Carmelina Avenue at Sunset Boulevard when Schwarzenegger’s 25-year-old son collided with their vehicle on October 30, 2020. Kakanyisa, aged 52, was driving a second car that was allegedly struck by the actor’s son. All three plaintiffs have named both Schwarzeneggers and the actor’s company, Oak Productions Inc., as defendants.

The Pirian-Kakanyisa lawsuit is separate from another lawsuit filed in Los Angeles Superior Court by 34-year-old Saam Takaloo against another Schwarzenegger son, actor and fitness model Joseph Baena. This case is currently before Judge Lisa R. Jaskol. Takaloo alleges that he was injured when Baena’s vehicle struck his on the southbound San Diego (405) Freeway in Culver City on April 5, 2021. The same defendants are named in his lawsuit.

Baena is Schwarzenegger’s son with his former housekeeper, Mildred Baena, from an alleged affair that became public in 2011 and led to the actor’s former wife, Maria Shriver, filing for divorce. Baena, aged 25, participated in the 31st season of “Dancing With the Stars” in 2022.
