Republicans Urge President Biden to Maintain Title 42

Republicans on the Senate Judiciary Committee are earnestly requesting that President Biden reverse his administration’s decision to terminate Title 42, as they believe it will worsen the ongoing migrant crisis on the southern border. Title 42, a policy created during the COVID-19 pandemic, has served to swiftly remove illegal migrants at the border. However, it is set to expire on May 11, and ranking member Lindsey Graham has referred to this date as a “nightmare.” Reports suggest that the number of migrants crossing the southern border into the U.S. may increase significantly, reaching between 10,000 and 13,000 per day once the Title 42 restrictions end. Graham, in a news conference, expressed his hope that the Biden administration, along with the support of Democrats, will choose not to repeal Title 42. The senators have composed a letter to President Biden, signed by members of the Judiciary Committee as well as Minority Leader Mitch McConnell, emphasizing the importance of Title 42 in maintaining order at the border. However, as Title 42 is a CDC policy linked to the Covid-19 emergency, it remains uncertain whether there is any legal authority to extend the rule beyond the emergency. Graham has urged Biden to find a suitable alternative for Title 42 if he is unable to maintain the current public health rule. According to Graham, migrant caravans are congregating along the border because they do not believe that other border policies, particularly Title 8, will offer an adequate substitute for Title 42. The senators’ letter implores Biden to reverse his decision to end the Title 42 public health order and highlights the potential consequences of border surges following the termination of the order. The senators express concern about the situation at the border, emphasizing that Title 42 has played a crucial role in deterring illegal crossings. They also criticize the administration’s CBP One app, designed to assist migrants in setting up asylum claim appointments, calling it a weak response that will not be effective during a surge of this magnitude. The senators argue that welcoming 13,000 border crossings per day would only exacerbate the current situation. They urge President Biden to take immediate action to secure the border. In response to the termination of Title 42, the Biden administration announced its plan to deploy 1,500 troops to the southern border by May 10. However, Republicans view this move as political theater and believe that it will not effectively address the issue. Senator John Cornyn has expressed skepticism about the troops’ impact, claiming that they will only perform administrative tasks. Similarly, Senator Lindsey Graham has criticized the deployment, emphasizing that it does not change the dynamics of the situation at the border. Former President Trump had previously sent troops to the border in 2018, with Graham asserting that Trump’s actions proved effective. Chairman Mark Green of the House Homeland Security Committee has also criticized the administration’s decision to deploy troops, arguing that it will not stop the influx of illegal migrants. It is estimated that a large migrant caravan is forming in Mexico, with approximately 35,000 asylum seekers waiting to cross into the U.S. interior after May 11. The number of apprehended migrants at the border has increased significantly, reaching 162,000 in March and 210,000 in April. So far in the 2023 fiscal year, there have been a total of 1.4 million illegal migrant encounters. The administration anticipates encountering nearly 400,000 migrants each month after the termination of Title 42, which poses a significant challenge for border patrol in containing the surge into the country’s interior. Border agents have reported intercepting over 73,000 illegal immigrants in the past 10 days alone.
