After Attorney General Merrick B. Garland promoted Weiss to special counsel, government lawyers stated in court papers last Friday that they were at an impasse in plea negotiations with Hunter Biden, and no agreement had been reached. Under the initial deal, Hunter Biden would have pleaded guilty to two tax misdemeanors and enrolled in a diversion program, which would have helped him avoid prosecution for the gun charge.
However, in a filing submitted late on Sunday, Hunter Biden refuted the prosecutors’ claim, emphasizing that he had signed the agreement in court the previous month and intended to honor it.
The extent to which this diversion agreement requires a judge’s approval for its implementation remains unclear.
The investigation appeared to be approaching its conclusion in June, with both parties announcing a deal. However, during a hearing before a federal judge in Delaware last month, where the agreement was expected to be finalized, divergent views emerged between Hunter Biden’s lawyers and Weiss’s prosecutors regarding a provision that offered Hunter Biden some level of immunity. As a result, the judge postponed the matter.
In the subsequent weeks, both sides attempted to salvage the agreement. Last Friday, Weiss hinted in court papers that he might take Hunter Biden to trial on the tax charges.
