Proactive Production Firms Push for Dismissal of Gerard Butler’s Non-Contract Claims

Nu Image/Millennium Films and Padre Nuestro Productions LLC have submitted new court documents seeking the dismissal of most of Gerard Butler’s lawsuit. Butler claims he is owed a minimum of $10 million in compensation for the 2013 movie “Olympus Has Fallen.” The defendants argue that the core of his case is a breach-of-contract claim.

Last July, Butler, 53, filed a lawsuit against Nu Image/Millennium Films and Padre Nuestro in Los Angeles Superior Court. He alleges that the production companies understated both domestic and foreign revenue by tens of millions of dollars and failed to report an $8 million payout to the firm’s executives.

In their recent court filings with Judge Jon R. Takasugi, defense attorneys assert that Butler’s claims of fraud, breach of the implied covenant of good faith and fair dealing, intentional interference with contractual relations, and a request for an accounting should be dismissed.

The defense lawyers further argue in their court documents that the only wrongs allegedly committed by any of the defendants are purported violations of the terms of the agreement between PNP and Butler. They assert that the only harm Butler supposedly suffered is the contractual and economic damages caused by PNP’s alleged breach or breaches.

“In other words, the only claim that reasonably arises or ever could arise from the allegations in Butler’s complaint is against PNP for breach of contract,” state the defense attorneys.

“Olympus Has Fallen” grossed $170 million worldwide. Butler also appeared in two successful sequels as U.S. Secret Service Agent Mike Banning, “London Has Fallen” and “Angel Has Fallen.”

According to the lawsuit, the production companies made tens of millions of dollars from “Olympus,” but did not share the gross revenue and profits as promised to Butler in their contract.

The suit alleges, “Instead, producers embarked on a scheme designed to grossly misrepresent the finances of the film to Butler so that Butler would believe that no such payments were due.”

A hearing for the defense’s motion to partially dismiss is scheduled for October 25.
