OpenAI’s ChatGPT Creator, OpenAI, Faces Investigation from FTC

The U.S. Federal Trade Commission (FTC) has initiated an investigation into OpenAI, the creator of ChatGPT, based on allegations that the company has violated consumer protection laws, potentially putting personal data and reputations at risk. This regulatory action poses a significant threat to OpenAI, which is backed by Microsoft and is credited with igniting the excitement around generative artificial intelligence. While consumers and businesses have been captivated by ChatGPT, concerns have emerged regarding its potential risks. In response, the FTC has sent a comprehensive 20-page request to OpenAI, seeking information on how the company manages risks associated with its AI models. The focus of the investigation is to determine whether OpenAI has engaged in unfair or deceptive practices, resulting in harm to the reputation of consumers. Of particular interest is how the company addresses the possibility of its products generating false, misleading, or damaging statements about real individuals. The Washington Post first reported on this investigation, and both the FTC and OpenAI have refrained from commenting at this time. As the race to develop more advanced AI services gathers pace, regulatory scrutiny of this groundbreaking technology grows. Global regulators are seeking to apply existing regulations related to copyright, data privacy, and two major concerns in AI: the input data used and the content produced by these models. Italian regulators had temporarily banned the use of ChatGPT in March, citing potential violations of the European Union’s General Data Protection Regulation (GDPR). However, the U.S. company was allowed to reinstate the service after it implemented measures such as age verification and the ability for European users to block their information from being utilized in training the AI model. As the discussions around AI regulation continue, U.S. Senate Majority Leader Chuck Schumer plans to organize forums later this year and advocates for comprehensive legislation to advance and ensure appropriate safeguards for AI.
