Breaking News: Settlement Reached in Lawsuit Alleging Teacher Molestation

In a significant development, a tentative settlement has been reached in a lawsuit brought on behalf of a young girl who was allegedly molested by a former district teacher. The accused teacher, Jose Cruz Martinez, had previously been sentenced to prison for his crimes.

The lawsuit, filed in August 2018 in Los Angeles Superior Court, claimed that Martinez molested the plaintiff, identified as Jane Doe, during the 2017-18 school year when she was just 12 years old. The victim’s attorneys have filed court papers notifying Judge Kevin C. Brazile of a “conditional” settlement in the case, and they anticipate filing a request for dismissal by January 11.

The lawsuit alleged multiple charges against both the district and Martinez, including sexual battery, sexual harassment, negligence, and intentional and negligent infliction of emotional distress.

Martinez, who was a second-grade teacher at Rowland Elementary School, is accused of molesting the girls between August 1, 2017, and April 1, 2018, while on campus.

The plaintiff’s claim states that she was only 7 years old when she suffered abuse.

Martinez, a 54-year-old resident of Rowland Heights at the time of the lawsuit, was sentenced to five years in prison in 2018 for his inappropriate actions towards the girls.

“Martinez abused his position of authority to repeatedly engage in inappropriate sexual conduct with Jane Doe…,” the lawsuit alleged.

The complaint reveals that much of the misconduct took place on school grounds and within plain sight of other administrators and staff members.

In addition to the inappropriate touching, Martinez allegedly painted the girl’s nails and gave her gifts and treats.

The lawsuit also contends that the district was aware or should have been aware of Martinez’s history of similar misconduct with other students.

In response to the allegations, the district’s lawyers have denied any liability on their client’s part, filing a cross-complaint against Martinez for indemnity.
