The Gates Ventures spokesperson asserted that such questioning would violate their agreement with Concentric, and representatives from Concentric denied asking questions about sexual or medical histories, suggesting that candidates may have volunteered the information. However, documents reviewed by The Wall Street Journal contradict Concentric’s characterization and indicate that the screening process was not solely for employment purposes. A consent form signed by candidates permitted Concentric to disclose highly sensitive information to Gates Ventures officials.

While there are no explicit legal prohibitions on asking questions related to sex during the hiring process, obtaining such information and taking adverse action based on it could be grounds for legal action. Female candidates for Gates’s private office reported being asked about their sexual histories, raising concerns about the appropriateness of these questions. In addition, questions about a candidate’s health or psychiatric history are prohibited under the federal Americans With Disabilities Act, as are inquiries about past illegal drug use.
